Trade Compliance

The customer (“Customer”) placing an order from EnjoyGadgets understands that delivery of products by EnjoyGadgets Electronics Inc. (“EnjoyGadgets”) takes place under the implicit or explicit agreement with EnjoyGadgets that the Customer has confirmed compliance with the export laws and the business conduct laws of the United States. All products (“products”), regardless of manufacturer sold by EnjoyGadgets are covered under this agreement.

Under OFAC and BIS regulations, products sold by EnjoyGadgets cannot be sold, shipped, or otherwise transferred into any destination that is subject to a U.S. government embargo and/or anti-terrorism controls, currently Balkans, Belarus, the Donetsk, Luhansk, and Crimea regions, Central African Republic, Congo, Cuba, Iran, Iraq, Lebanon, Liberia, Libya, North Korea, Russian industry sector, Somalia, Syria, Venezuela, Yemen, and Zimbabwe.

EnjoyGadgets products cannot be sold, shipped, or otherwise transferred, directly by the Customer or by one of the customer’s customers or resellers to any of these restricted destinations.

Products sold by EnjoyGadgets cannot be sold, shipped, or otherwise transferred to any prohibited individuals or entities listed on the relevant U.S. lists of prohibited parties, as amended from time to time:

• the BIS’s Denied Persons List;
• the BIS's Entity List, and
• the BIS's Unverified List.

It is important to note that these lists are regularly updated and amended, and it is the Customer's responsibility, and the responsibility of Customer's direct and indirect customers, to monitor the list to assure compliance with any and all updates thereto.

Failure to comply with U.S. and other applicable global export control and trade and economic sanctions laws and regulations can result in criminal sanctions, civil fines, debarment from government contracting, the loss of export privileges, and imprisonment. The reach of these laws and regulations covers U.S. persons as well as foreign persons, wherever located; Additionally, any failure to abide by these regulations may result in termination of your ability to purchase any future products from EnjoyGadgets.

The customer is responsible for ensuring that any of your direct and indirect employees, contractors, affiliates, and customers are clearly made aware of these regulations, as they are each amended from time to time. By directly or indirectly selling, shipping, using or otherwise transferring EnjoyGadgets’s products, you are agreeing to comply with all applicable export and reexport control laws and regulations, including each of those referenced herein.

When placing an order with EnjoyGadgets, the Customer agrees to this Trade Compliance and will make all efforts to ensure compliance.
